By signing this Agreement, the Guest consents and agrees that the Organizer and the Organizer's employees, officers, sponsors, partners, interns, agents, representatives, and contractors have the right to photograph, videotape, audio record, or otherwise digitally record the Guest before, during, and after the Retreat. The Guest grants the Organizer and its subsidiaries, affiliates, successors, assigns, and licensees a full, global, irrevocable right and permission to use, reproduce, publish, display, distribute, transmit, and otherwise use such recordings, and the Guest’s name, image, voice, likeness, and identity contained therein, for marketing, advertising, promotion, social media, educational content, recordkeeping, and any other lawful business purpose, in any and all media now known or later developed, whether publicly or privately. The Guest understands and agrees that there will be no financial or other remuneration for any such use and waives any right to inspect, approve, or control such use. The Guest further understands and agrees that the Organizer may retain documents, information, data, and recordings acquired or shared before, during, or after the Retreat for as long as reasonably necessary to fulfill the purposes of this Agreement, exercise Organizer's rights under this Agreement, and comply with applicable legal, accounting, insurance, dispute resolution, or recordkeeping obligations. The Organizer will use commercially reasonable measures to safeguard such records against unauthorized access, disclosure, or loss, and may maintain such records in print, digital, electronic, or other formats of Organizer's choice. The Guest understands and agrees that neither the Organizer nor the Organizer's employees, officers, sponsors, partners, interns, agents, representatives, and contractors are responsible or liable for any expense, loss, damage, or liability incurred by the Guest arising from or related to such recording or use, except to the extent caused by the Organizer's gross negligence or willful misconduct.
