This Retreat Agreement (the "Agreement") is between you (the "Guest") and Elizabeth Grace Ann Dunbar LLC d/b/a Thriving Feminine (the "Organizer"). Please read this Agreement and all policies carefully.

This Agreement sets out our mutual expectations for the Retreat. By signing, you confirm that you have read and understand this Agreement and all incorporated policies. You must be of the age of majority in your jurisdiction to enter into this Agreement.

Definitions

  • Agreement: The entire Retreat agreement between Elizabeth Grace Ann Dunbar LLC doing business as (DBA) Thriving Feminine and you the Guest
  • Approved Transferee: The person that is approved by the Retreat Organizer that a former Guest transfers their booking to.
  • Guest: Person attending the retreat, the undersigned (electronically or by hand) or person who has clicked “I Agree” (or something similar) to this Agreement ("Guest", "Guests", “you” and “your”). Where "Guests" is used in the plural, each individual Guest is personally bound by and responsible for all obligations under this entire Agreement.
  • Organizer: Elizabeth Grace Ann Dunbar LLC DBA Thriving Feminine, and its owners, members, managers, employees, officers, sponsors, partners, interns, agents, representatives, and contractors ("Organizer", "me", "we")
  • Parties: This Agreement is made between Elizabeth Grace Ann Dunbar LLC DBA Thriving Feminine operating in the Commonwealth of Virginia and you the Guest, the person attending the retreat, the undersigned (electronically or by hand) or person who has clicked “I Agree” (or something similar) to this Agreement ("Guest", "Guests", “you” and “your”).
  • Term: March 6 - 13, 2027
  • Retreat: The Thriving Feminine Retreat Bali 2027
  • ​​​​​​​Retreat Country: The country or countries where the Retreat takes place
  • Venue: Where the retreat will take place (the Soulshine Bali Resort)
  • WeTravel: Trusted third-party partner platform providing retreat and travel management services

Retreat Packages

All package costs are listed per person and are determined by the type of accommodation Guest books. The cost to reserve Guest accommodation for the retreat includes the cost of the retreat.

​​​​​​​The retreat includes the following but is subject to change:

  • Accommodation at Soulshine Bali for the duration of the retreat
  • Daily breakfast & dinner
  • Classes and embodiment experiences
  • Water temple visit
  • Balinese cultural evening
  • Balinese New Year celebrations
  • Whole group excursions
  • Roundtrip airport transfer between I Gusti Ngurah Rai International Airport (DPS) and the Soulshine Bali resort ONLY
  • A spa experience (to be defined at a later date)
  • and some surprises

​​​​​​​The retreat does not include:
  • Flights to and from Bali
  • Visa documentation and/or associated costs
  • Immunizations and medication
  • Travel & health insurance
  • Daily lunches
  • Beverages (including alcoholic drinks, soft drinks, juices, tea and coffee, etc.)
  • Optional excursions and activities
  • Personal purchases (souvenirs, shopping, personal expenses)
  • Additional à la carte experiences at the resort or off property

Travel & Retreat Management

The Retreat is offered, booked, and administered in conjunction with WeTravel, a trusted third-party travel management platform. Your use of WeTravel - including account creation, booking, and communications - is governed by WeTravel's own terms of service and policies, as amended from time to time.

The Organizer is not responsible or liable for WeTravel's platform terms, policies, acts, omissions, availability, or performance. Payments made through WeTravel remain subject to this Agreement, including all payment, cancellation, refund, transfer, and dispute provisions. In any conflict between this Agreement and a third-party platform's terms, this Agreement shall control as the Agreement between the Organizer and the Guest. Payment and Cancellation

The Thriving Feminine Retreat package reservation and payments are non-refundable and cannot be cancelled under any circumstances.

By booking the Retreat, making the initial payment, signing this Agreement, or attending the Retreat, the Guest confirms they have read, understood, and accepted all terms and conditions set forth herein and enters into a binding agreement.

By booking the Retreat, making the initial payment, and/or signing this Agreement, the Guest also:

  • Reserves their spot on the retreat
  • Agrees that Retreat payments are non-refundable
  • Agrees that the Guest is responsible for fulfilling all payments associated with Guest's reservation package prior to arriving at the retreat
  • If the Guest cannot attend the retreat, the Guest agrees that their purchase can only be transferred to another person if:
    • The Guest finds a prospective guest to transfer the booking to (transferee) on their own that is approved by the Retreat Organizer
    • Approved Transferee accepts the terms of the Agreement and signs the Agreement
    • The Guest charges the Approved Transferee the same or less than what Guest paid for the retreat and work out the details of any payments between the Guest and the Approved Transferee privately
    • The Guest or the Approved Transferee continue to make payments to the Retreat Organizer according to the payment schedule and terms & conditions without interruption

If you can no longer attend the Retreat, please find an Approved Transferee or consult your travel insurance, as packages cannot be refunded under any circumstance.

This clause applies whether the Guest or a representative books, pays, or signs on their behalf.

Travel Insurance

Guests are required to secure travel insurance for the retreat and are recommended to do so as early as possible after paying the deposit as payments for the Retreat are non-refundable and cannot be cancelled under any circumstances. Please review the Additional Retreat Policies for more information and guidelines on travel insurance.

Travel insurance may be available through our third-party partner WeTravel. Any such insurance is offered, underwritten, and administered solely by WeTravel and/or its insurance providers - not the Organizer. The Organizer assumes no liability for any insurance policy purchased through WeTravel, including its availability, terms, coverage, or claims processing. For more information, see our Additional Retreat Policies.

Travel Booking and Documentation

Guests are responsible for booking and paying for their own flights and ensuring they will be permitted to enter the Retreat country. Guests must obtain and maintain valid travel documentation, including passports, visas, immunizations, and any other required documents. The Organizer is not responsible for Guests being denied entry into or exit from any country due to insufficient or invalid documentation. Guests who miss part or all of the Retreat due to documentation or legal issues are not entitled to a refund. Note: many countries require a passport valid for at least 6 months beyond the date of travel.

Transportation Disclaimer

Transportation used before, during, or after the Retreat - whether arranged, recommended, or provided in connection with the Retreat - may include cars, shuttles, scooters, motorcycles, vans, taxis, rideshares, boats, or other vehicles operated by independent third parties. These providers are not the Organizer or its representatives. The Organizer is not responsible or liable for any accident, injury, death, loss, damage, delay, or expense arising from the Guest's use of such transportation. Guests voluntarily assume all risks associated with such transportation, including the use of scooters, motorcycles, or similar vehicles.

Resort and Retreat Accessibility

While the Organizer will make reasonable efforts to accommodate accessibility needs, not all needs can be accommodated. This Retreat may not be suitable for wheelchair users, as most areas of the Venue, the Soulshine Resort - including classrooms, the restaurant, and many guest rooms - are accessed by stairs. Many excursions are also inaccessible by wheelchair.

Medication, Illegal Substances, and Intoxication

Guests are responsible for bringing any prescription and over-the-counter medication they need to maintain their physical, mental, and emotional health and wellbeing during the Retreat. Guests understand that some medications or substances that are legal, customary, or readily available in the Guest’s home country may be illegal, restricted, unavailable, or difficult to obtain in the Retreat Country. Guests are solely responsible for researching in advance whether any medication or substance they may bring or require is legal, permitted, and accessible in the Retreat Country, and for obtaining and carrying all documentation that may be required. Guests are fully responsible for any and all consequences arising from the possession, transport, attempted importation, unavailability, or inability to access any medication or substance in the Retreat Country, including fines, confiscation, denial of entry, arrest, incarceration, or other penalties. Guests are prohibited from bringing illegal substances to the Retreat. The Organizer and the Organizer's employees, officers, sponsors, partners, interns, agents, representatives, and contractors are not responsible or liable for any consequence, injury, loss, damage, or other tangible or intangible harm arising out of or related to the Guest’s medication or substance choices, intoxication, impaired judgment, or violation of applicable laws.

Force Majeure: Retreat Cancellation Due to Unavoidable Circumstances 

For the purposes of this Agreement, a “Force Majeure Event” means any event or circumstance beyond the reasonable control of the Organizer and/or Venue that prevents, substantially hinders, makes illegal, makes unsafe, or makes impossible the hosting of the Retreat as scheduled, including but not limited to acts of God (such as fire, flood, earthquake, or hurricane), war, civil unrest, terrorism or threats thereof, government-imposed restrictions or travel bans, pandemics, epidemics, labor strikes, failure of transportation systems, Organizer injury or illness, Venue closure, death or incapacitation, or other unavoidable event or circumstance. In the event of a Force Majeure Event, the Organizer shall notify the Guest as soon as practicable. All packages affected by such cancellation shall be transferred to a new date and/or location. The Organizer will use reasonable efforts to reschedule the Retreat within twelve (12) months of the original Retreat dates; provided, however, that if the Force Majeure Event or its effects continue beyond that period, the Organizer may extend the rescheduling timeline as reasonably necessary. If rescheduling does not occur within twenty-four (24) months of the original Retreat dates, or if the Organizer dies or becomes permanently incapacitated such that rescheduling is not reasonably possible, Guests shall be entitled to a refund of amounts actually paid, less any documented, reasonable, non-recoverable third-party costs already incurred by the Organizer on the Guest’s behalf (such as venue deposits, vendor commitments, and similar expenses). The Organizer shall provide an accounting of such costs upon the Guest's reasonable written request. Except as expressly stated in this clause, the Organizer is not otherwise responsible or liable for issuing refunds to the Guest. The Guest is highly recommended to research and obtain travel insurance that contains trip cancellation and interruption coverage that includes but is not limited to the events and circumstances listed above.

Laws

Guest must follow all applicable international, national, regional, and local laws while on the Retreat, Guest is responsible for researching and understanding applicable laws.

Bookings and Payment

Bookings and payments for the Thriving Feminine Retreat will be processed through WeTravel or Stripe.

Payment plans are available for the Retreat. Please note, all payment plans are set to end in February 2027 and must be paid in full by February 28, 2027, at the latest. Payment plan terms will be outlined by WeTravel at the time of checkout and reiterated by confirmation email. The Guest understands, accepts, and agrees that the earlier Guests register for the retreat, the more flexible the payment plans that will be available.

Guests that intend to pay for the Retreat through contributions pages and crowdfunding understand, accept, and agree they are still responsible for, at minimum, meeting the payment schedule outlined in their payment plan. See policies for more on contributions pages

Disputes & Disputed Charge Fee

Even though Guest has purchased the Retreat from Elizabeth Grace Ann Dunbar LLC, doing business as Thriving Feminine, credit card, wire, and bank charges may show up as "Elizabeth Dunbar Thriving Feminine", "Elizabeth Grace Ann Dunbar LLC", "Thriving Feminine", 'WeTravel', or a variation thereof. Please do not dispute any agreed upon charges associated with this retreat. Instead, reach out to retreats@thrivingfeminine.com to check payments, payment history, and billing.

As no cancellations or refunds are possible for this retreat, Guest understands, accepts, and agrees that any disputed charges or actions that go against Payment Terms & Conditions will be charged a $250 administrative fee to cover Organizer's reasonable costs in responding to and resolving the dispute, even if the dispute is withdrawn.

Disputes will be handled through WeTravel and are generally resolved within 2-3 months from the time that WeTravel submits evidence to a bank or credit card company. This is the case even if the participant has withdrawn the dispute in the meantime. Banks are permitted 3 months from the date of evidence submission to reach a resolution (see this article by the US Consumer Financial Protection Bureau).

Confidentiality of Guest Personal Information

The Guest understands, accepts, and agrees that during the Retreat they may learn personal, sensitive, or personally identifying information (PII) about other Guests (“Personal Information”). Guests and all retreat participants should be aware that there is a reasonable expectation of privacy concerning all PII and personal information shared for the purposes of this retreat which they should regard as confidential. The Organizer will handle Guest personal information in accordance with applicable law and its privacy practices.

The Guest agrees to keep such Personal Information strictly confidential and not to disclose, share, post, publish, record, or communicate the personal stories and sensitive experiences shared on the Retreat by Guests to any third party without the prior express written consent of the applicable Guest.

The Guest may share their own general lessons, insights, reflections, or takeaways from the Retreat so long as they do not include any identifying or reasonably identifying information of another Guest.

Underlying Conditions and Undue Reliance

The Guest agrees that guidance provided by Organizer and the Organizer's employees, officers, sponsors, partners, interns, agents, representatives, and contractors does not constitute medical, legal, financial, mental health, or other professional advice and should not be relied upon as a substitute for advice, diagnosis, treatment, or services from qualified licensed professionals. The Guest agrees to seek independent guidance as needed from qualified professionals based on the Guest’s personal situation.

Guest Code of Conduct

By booking and attending the Retreat, you agree to honor and uphold these fundamental principles:

  • Respect for All: You pledge to respect fellow Guests, other resort guests, resort staff, guides, locals, and the Organizer and the Organizer's employees, officers, sponsors, partners, interns, agents, representatives, and contractors regardless of their race, ethnicity, beliefs, sexual orientation, gender identity, or any other aspect of their identity.

  • Zero Tolerance for Discrimination: There is no room for discrimination, sexism, racism, or any form of prejudice on our retreats. This includes both explicit actions and microaggressions. We strive for an environment where everyone feels valued.

  • Zero Tolerance for Violence: There is a zero-tolerance policy for physical violence or threats of physical violence against fellow Guests, other resort guests, resort staff, guides, locals, and the Organizer, Organizer's employees, officers, sponsors, partners, interns, agents, authorized representatives, and contractors.

  • Consequences for Violations: Organizer reserves the right to remove any Guest from the Retreat and the Resort Venue at any point, without a refund, should they breach the code of conduct. The Guest may also be banned from attending any future Organizer Retreats and events

Media Release: Records and Retention

By signing this Agreement, the Guest consents and agrees that the Organizer and the Organizer's employees, officers, sponsors, partners, interns, agents, representatives, and contractors have the right to photograph, videotape, audio record, or otherwise digitally record the Guest before, during, and after the Retreat. The Guest grants the Organizer and its subsidiaries, affiliates, successors, assigns, and licensees a full, global, irrevocable right and permission to use, reproduce, publish, display, distribute, transmit, and otherwise use such recordings, and the Guest’s name, image, voice, likeness, and identity contained therein, for marketing, advertising, promotion, social media, educational content, recordkeeping, and any other lawful business purpose, in any and all media now known or later developed, whether publicly or privately. The Guest understands and agrees that there will be no financial or other remuneration for any such use and waives any right to inspect, approve, or control such use. The Guest further understands and agrees that the Organizer may retain documents, information, data, and recordings acquired or shared before, during, or after the Retreat for as long as reasonably necessary to fulfill the purposes of this Agreement, exercise Organizer's rights under this Agreement, and comply with applicable legal, accounting, insurance, dispute resolution, or recordkeeping obligations. The Organizer will use commercially reasonable measures to safeguard such records against unauthorized access, disclosure, or loss, and may maintain such records in print, digital, electronic, or other formats of Organizer's choice. The Guest understands and agrees that neither the Organizer nor the Organizer's employees, officers, sponsors, partners, interns, agents, representatives, and contractors are responsible or liable for any expense, loss, damage, or liability incurred by the Guest arising from or related to such recording or use, except to the extent caused by the Organizer's gross negligence or willful misconduct.

No Guarantees

The Guest understands that while the Organizer will try to ensure Guests have a wonderful Retreat experience, the Organizer makes no guarantees, representations, or warranties that the Retreat will proceed exactly as planned, that any particular activities, teachers, sessions, excursions, amenities, accommodations, schedules, locations, or experiences will be available as anticipated, or that the Guest will achieve any particular outcome, result, transformation, benefit, or experience from participating in the Retreat, as all such results and experiences are subjective and may vary.

Limitation of Liability and Warranty Disclaimer

Except as expressly provided in this Agreement, the Organizer and the Organizer's employees, officers, sponsors, partners, interns, agents, representatives, and contractors make no guarantees, representations or warranties of any kind or nature, express or implied, with respect to the retreat and guidance services agreed upon and rendered. In no event shall Organizer and the Organizer's employees, officers, sponsors, partners, interns, agents, representatives, and contractors be liable to the Guest for any indirect, consequential, incidental, punitive, or special damages. Notwithstanding any damages that the Guest may incur, the Organizer and the Organizer's employees, officers, sponsors, partners, interns, agents, representatives, and contractors' entire liability under this Agreement, and the Guest’s exclusive remedy, shall be limited to the amount actually paid by the Guest to the Organizer under this Agreement for all Retreat and guidance services rendered before, during, and after the Retreat Term.

Assumption of Risk, Indemnity, and Waiver

The Guest acknowledges that participation in the Retreat involves inherent risks, including risk of injury, death, and property damage. The Guest accepts all such risks and, to the fullest extent permitted by law, releases, indemnifies, and holds harmless the Organizer and its employees, officers, sponsors, partners, agents, representatives, and contractors from any and all claims, liabilities, losses, damages, costs, expenses, and attorneys' fees (including the costs of defending against any claim) arising out of or related to the Guest's participation in the Retreat — whether occurring during or after the Term — except to the extent caused by the Organizer's gross negligence or willful misconduct.

The failure of either party to enforce any provision of this Agreement shall not constitute a waiver of that party's right to enforce strict compliance with this Agreement at any time. A waiver of any breach shall not be construed as a waiver of any subsequent breach

Severability

If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If the Court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

Applicable Laws

This Agreement shall be governed and construed in accordance with the laws of the Commonwealth of Virginia, USA, without giving effect to any conflicts of laws provisions.

Arbitration

Any controversy or claim arising out of or relating to this Agreement or the breach of this Agreement shall be settled exclusively by binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules, or by the International Center for Dispute Resolution when a Guest resides outside of the United States, in accordance with its applicable rules. The seat of any such arbitration shall be in the Commonwealth of Virginia. The Guest agrees that any arbitration shall be conducted on an individual basis only and not as a class, consolidated, or representative action. Arbitration fees and costs shall be allocated in accordance with the applicable arbitration rules.

Online Agreement

Guest and Organizer agree that this Agreement may be signed electronically or agreed to by electronic signature, typed signature, or clicking “I Agree” (or something similar), and will be regarded as the same as if the Agreement was signed by hand. 

Agreement

I, herein stated as the Guest, have read the above Retreat Agreement and Media Release and fully understand, accept, and agree with its contents. I am legally able to sign and voluntarily agree to and accept all terms stated above. This Agreement becomes binding upon execution by digital or physical signature, or by clicking "I Agree" (or something similar), whether before, at the time of, or after booking and initial payment.
